Court Grants Wounded Warrior Project (WWP) Requested Injunction
JACKSONVILLE, Fla., July 21 /EMWNews/ -- Wounded Warrior Project received word last Monday from the District Court of Nebraska that a preliminary injunction was entered against Wounded Warriors, Inc., requiring the organization to close down a website which has been the source of much donor confusion, and requires the organization to specifically disclose on all future websites it is not affiliated with WWP. The court found that all of the factors that are elements of consideration for the granting of injunctive relief under the Nebraska Deceptive Trade Practices Act had been met by WWP. The Court, in part, relied upon admissions by the defendant in the case that there had been actual instances of confusion. "We are pleased that the court granted this extraordinary remedy to alleviate a very disturbing situation," stated Errol Copilevitz, Outside Counsel for Wounded Warrior Project. The Court's ruling in this case is in support of "donor intent." Those who sought to support the Wounded Warrior Project should not be confused in supporting other organizations with confusingly similar names. Previous to this ruling, Wounded Warrior had changed its name to be Wounded Warriors Family Support and as part of the decision, any new website developed must contain the disclaimer "This site is not affiliated with the Wounded Warrior Project." "It remains in the best interest of all veteran's charities to ensure wounded veterans are served and that donor monies be directed to the organization running the programs they choose to support," said Copilevitz. "It is our hope that with this decision both organizations can move forward conducting their business in a manner that is reasonable and fair."
